By accessing and using this website, you indicate that you have read and understand these Terms of Use and Privacy Policy and agree to abide by them at all times. If you do not agree with any part of these terms, please do not use this site or its services.

The Nature of Our Work Together:

My work exists to complement yours. For our work together to be successful, it must be built on a foundation of mutual respect and clear boundaries. These terms ensure that while you grow your brand with my designs, the integrity of the original artwork is preserved.

Ownership & Copyright: 

All content published on this site — including images, patterns, logos, files, and documents — is the property of me, Cat Doxford. Unless we agree otherwise in writing, I retain all intellectual property rights and copyright in my work.

I make my work available in three ways:

  • Library Licensing: If you license a pattern from my existing library, you are granted a non-exclusive (or other agreed upon exclusivity tier) license to use that design commercially within the product categories, territories, and timeframe set out in your contract. No rights are granted to resell, redistribute, or modify the designs beyond permitted usage.

  • Copyright Buyout: If you purchase a full copyright buyout, I assign all intellectual property rights in the applicable design to you permanently. You become the legal owner of copyright in that work, and I will not sell or license it to any third party. I retain the right to display the design in my portfolio.

  • Custom Commissions: If I create a bespoke design for you, the intellectual property rights in that work are subject to the terms we agree upon in your contract — either a restricted commercial license or a full copyright buyout, as selected and paid for upfront.

Full terms governing your specific project — including licensing scope, payment, delivery, and any rights transfer — will be set out in a written service agreement between us before any work begins.

Moral Rights: 

As an artist in Canada, I retain my Moral Rights. This means that the work cannot be used in a context that would be prejudicial to my honour or reputation, and my name must remain associated with the design where appropriate.

Usage Boundaries: 

Your licence is specific to the products and timeframes we agree upon in our contract. Using a design for a product category not specified in our agreement — for example, moving from apparel to home goods — requires a separate conversation and an adjusted licence.

Protection of Work: 

It is strictly prohibited to use, reproduce, modify, derive other works from, or adapt any of my designs without prior consent. The watermarks and metadata on this site and in my files are there to protect the integrity of my work and its origins — removing them is a violation of these terms.

Acceptable Use:

As a user of this site, you agree to use it legally and respectfully. You agree not to:

  • Harass or mistreat Cat Doxford or any third party;

  • Violate my intellectual property rights or those of any third party;

  • Act in any way that could be considered fraudulent.

I reserve the right to limit or terminate your access to the site if these terms are violated.

Professional Limitations & Commercial Outcomes: 

While my designs are created with marketability and strategy in mind, the commercial success of a product depends on many variables — from marketing to market shifts — that are beyond the scope of these terms. I cannot guarantee specific commercial results, sales volumes, or profits.

In no event shall Cat Doxford be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, or damages for loss of profits, revenue, goodwill, or data, even if advised of the possibility of such damages.

Except where prohibited by law, Cat Doxford will not be liable for any actions, claims, losses, or expenses arising from your use of this site, your use of Cat Doxford's services, or any products or designs that you purchase or license from Cat Doxford.

By using this site, procuring services from Cat Doxford, or purchasing or licensing any products or designs from Cat Doxford, you indemnify and hold harmless Cat Doxford from any claims or legal fees arising out of your use of this site, your use or inability to use any products or designs purchased or licensed from Cat Doxford, or your violation of these terms.

Except as expressly set out in these terms, Cat Doxford makes no representations or warranties of any kind, express or implied, including without limitation any warranty that designs or artwork provided are non-infringing of third-party intellectual property rights. Notwithstanding the foregoing, this disclaimer shall not apply in any circumstance where Cat Doxford is found to have intentionally infringed third-party intellectual property rights.

Production Standards:

To ensure the highest quality outcome for your project, please note the following:

  • Colour Accuracy: All files are delivered in sRGB colour profile as standard. CMYK or Pantone conversions are available upon request and should be confirmed at the proposal stage. Variations in colour and finish are a natural part of the printing process and will occur across different fabric bases (such as the difference between the matte texture of linen and the sheen of silk).

  • Fabric Strike-Offs: To ensure your vision is realised perfectly, I strongly recommend printing a physical strike-off (sample) before moving to full-scale production. I cannot be held liable for production results where a sample was not approved first.

Applicable Law: 

These Terms are governed by the laws of the Province of British Columbia.

Severance

If any provision is found to be invalid under applicable law, it will be removed without affecting the validity of the remaining terms and conditions.
